A person once given the status of bankrupt by the UK government; all his or her non essential assets will be liquidated to pay the debt of creditors. Even after doing so if the debt is not fully cleared, the debtors cannot legally chase the person for recovering debt.
However, all the loans are not magically vanished by acquiring bankruptcy status. Loans like student loan, child support and law suits are to be paid, even if the person is announced bankrupt.
The majority of cases in UK where Bankruptcy is filed the applier has undergone a life changing incident. Incidents like divorce, major ailment or loss of failing business etc. The loans accumulated in such a traumatic scenario are huge and cannot be paid back under normal conditions. Once the proceedings are done by the government and all the non essential assets of the applier are liquidated. The applier is declared as bankrupt by the UK government. The entire process from the start to end is held at the county court itself. The status of the person as bankrupt is made public notice and the name of the bankrupt is published in newspaper and letters are sent to outstanding creditors. In the UK credit report will show bankruptcy for the period of five years but if the person is declared bankrupt for the second time then the time may go up to fifteen years.
The person running any current business or having an account will be immediately closed as he is declared bankrupt. Getting loan or credit card becomes impossible for a person once declared bankrupt.
For certain scenario declaring bankruptcy becomes the best solution for an individual. A person considering bankruptcy certainly requires sound bankruptcy advice from professionals before taking the plunge.
